RECREATIONAL VEHICLE STORAGE AGREEMENT

POINT NIPIGON ON-THE-STRAITS RESORT CLUB

BACKGROUND:

The Rules of Point Nipigon On-the Straits Resort Club (“Point Nipigon”) do not permit the storage of recreational vehicles, including boats, snowmobiles, jet skis, campers, RVs, and the like, may not be parked by or around cottages in which they are visible from the road.

However, Point Nipigon provides a seasonal storage area for such vehicles just east of the Property Manager’s residence. During the summer, members may launch and temporarily store boats while they are being used at The Point.

AGREEMENT:

The undersigned recreational vehicle owner (Owner) and member of Point Nipigon agrees to the following in order to store a recreational vehicle(s) on the property of Point Nipigon set aside for the storage of members’ recreational vehicles and/or to launch a water vehicle at

The Point:

1. This Agreement authorizes the Owner to store recreational vehicle(s) (as approved by the Point Nipigon Property Manager) in its Recreational Vehicle Storage area, provided, however, that Point Nipigon may terminate this Agreement at any time, for any reason, with six months written notice, whereupon the Owner shall remove all of Owner’s recreational vehicles from the storage area.
2. In consideration of the use of the Seasonal Vehicle Storage Area and Point launching area, Owner agrees to indemnify and hold Point Nipigon harmless from all losses, damages, liabilities, and expenses which may arise or be claimed against Point Nipigon for any injuries or damages to the person or property of any person, firm, corporation, or other entity arising from acts, omissions, neglect, or fault of the Owner or Owner’s family, agents, employees, licensees, or invitees, or said person’s failure to comply with all relevant and applicable governmental laws, statutes, ordinances, or regulations. Owner agrees that Point Nipigon shall have no responsibility and shall not be liable for any injuries to the Owner, members of Owner’s family, or invitees of Owner while they are in Point Nipigon’s seasonal Vehicle Storage Area and at The Point, provided such injuries are not caused by gross negligence of Point Nipigon, its agents, and/or its employees.
3. Owner agrees to have the vehicle insured by an applicable insurance policy (damage, theft, and indemnity liability coverage) and to provide Point Nipigon with a copy of said policy on request.
4. Owner is responsible for parking the vehicle in a manner that does not block access to the adjacent power line easement or the ingress and egress of other recreational vehicles to and from their assigned storage locations.
5. Owner agrees not to hold Point Nipigon liable for any loss caused by winter storage, weather, or other events beyond the control of Point Nipigon, provided that loss is not caused by the gross negligence of Point Nipigon or its agents and/or employees.
6. In the event of an emergency affecting the vehicle or other vehicles in the storage area or at the Point, or persons or property, Point Nipigon, at its sole discretion, reserves the right to move the vehicle provided that Point Nipigon shall not be required to provide this service. Owner shall indemnify and hold Point Nipigon safe and harmless from any and all liability, injury, loss, or damage to Owner’s vehicle (and any personal property therein or thereon caused by or resulting to Owner’s vehicle due to an emergency situation.
7. Owner is responsible for any costs and expenses incurred by Point Nipigon in removing Owner’s recreational vehicle(s) from the Point Nipigon Seasonal Storage Area or The Point as authorized in this Agreement.
8. This Agreement shall be construed, interpreted, and enforced in accordance with the laws of the State of Michigan.
9. The terms of this Agreement shall be binding upon the heirs, representatives, and successor of the Owner and Point Nipigon.

THE OWNER AGREES TO COMPLY WITH SUCH REASONABLE REGULATIONS AS POINT NIPIGON MAY

PUBLISH, POST, AND/OR DISTRIBUTE FROM TIME TO TIME. A COPY OF THE “NIPIGON RULES” IS

AVAILABLE FROM THE BUSINESS MANAGER.
